We will from this point on refer to the above list of websites (and any applications/apps directly related to said websites) singularly as "Website" or collectively as "Websites".

 

"Client", “You”, “Yourself”, "Your" and “User” refers to you, the person accessing these websites and accepting the Company's terms and conditions. "The Company", "Teacher's Pet", “Ourselves”, “We” and "Us", refers to Jason Loftus and Christina Loftus trading under the name "Teacher's Pet". “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.

 

Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

 

 

Services

 

 

We are a provider of completely free printable, high quality classroom display resources and we call this the 'Displays Service'. All classroom displays are provided 'as is' for free via http://displays.tpet.co.uk (and the related 'companion' app on Apple iOS and Android containing the same resource content) - We accept donations should you wish to show gratitude for the Displays Service, donation links can be found on the resource pages.

 

We are a provider of premium, high quality, printable activities and games and we call this the 'Activities Service'. All our activities and games are provided 'as is' and are available to users upon payment of a yearly access fee as outlined on http://activities.tpet.co.uk

 

Teacher's Pet allows the purchase of pre-made resources via the Teacher's Pet 'Shop' found at http://shop.tpet.co.uk and we call this the 'Shop Service'

 

We reserve the right to change pricing and availability on any and all services without notice and for any reason we deem appropriate.

 

We will not be held responsible for technical limitations of any end-user for any reason in respect to any of the services above. We provide a technical support service via email but we do not guarantee the availability of a resolution to any limitations out of our control.

 

 

Member Accounts

 

 

Some aspects of our websites such as our Activities Service and our Shop Service will require you to provide personal information to us in order to register for said services. You agree to provide honest, current, complete and accurate information about Yourself via the relevant registration form. You also agree to use the functionality of the websites and services to keep this information current and accurate should it change and we will not be held responsible for any loss suffered by Your neglect of this provision including but not limited to - goods being delivered to an address no longer accessible by Yourself.

 

We appreciate that the internet is not a secure environment. However We endeavour to protect all personal information provided by yourself through the Websites in accordance with strict data protection standards including but not limited to encrypted storage of user data in our securely hosted database environments.

 

Our various registration processes will involve you creating a password in exchange for an account that is provided by Us. It is your sole responsibility to manage the security and confidentiality of your password and account. You will be held fully responsible for the activity the occurs on your account. You must notify Us immediately of any unauthorised use of your account or any other breach of security. We cannot be held responsible for any loss or damage that occurs from your neglect of this obligation.

 

 

Activities Service

 

 

Our Activities Service subscription is subject to these Terms and Conditions in an addition the following conditions shall apply to this service.

 

You agree that a breach of any of the general Terms and Conditions will lead to Your access to the Activities Service being immediately suspended. It is at Our absolute discretion as to whether Your account will be reinstated.

 

 

Acceptable use

 

 

You must not use our Websites in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the websites; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

 

You must not use our Websites to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

 

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our Websites.

 

You must not use our Websites to transmit or send unsolicited commercial communications.

 

 

Privacy Statement

 

 

We are committed to protecting your privacy. Authorised employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers.

 

Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

 

 

Indemnity

 

 

You hereby indemnify Teacher's Pet and undertake to keep Teacher's Pet indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Teacher's Pet to a third party in settlement of a claim or dispute on the advice of Teacher's Pet legal advisers) incurred or suffered by Teacher's Pet arising out of any breach by you of any provision of these terms and conditions[, or arising out of any claim that you have breached any provision of these terms and conditions].

 

 

Activities Service Acceptable Use

 

 

The Activities Service is subject to an acceptable use policy, and user accounts are monitored. We impose a download limit of 50 downloads per week (downloads not used at the end of the week are forfeited and cannot be carried over to the next weeks quota), users regularly hitting this limit will be subject to review. (We do not allow users to aggressively download our entire catalogue of resources one week at a time, any such activity will lead to account suspension and the intentions of the user being called into question as per our copyright terms and conditions)

 

 

Activities Service Gift Vouchers

 

 

We offer users a way of purchasing a gift voucher for friends or colleagues at the current cost of an Activities Service subscription. Gift cards are non-refundable and have no cash value. Recipients of gift vouchers must also agree to all of the Terms and Conditions in order to be given access to the Activities Service.

 

Gift vouchers are sent through the post via Royal Mail and will arrive with you within 7 working days. Alternatively you can request a digital version by contacting us directly prior to purchase.

 

 

Modifications to Services

 

 

Teacher's Pet reserves the right at any time and from time to time to modify or discontinue any service on the Websites (including but not limited to - Activities Service, Shop Service and the Displays Service or any part thereof) temporarily or permanently with or without notice.

 

You agree that We shall not be held liable to you or to any third party for any modification, suspension or discontinuance of any service

 

 

Account Termination

 

 

You agree that Teacher's Pet, in it's sole discretion and without liability to you or any third party may suspend or terminate, with or without notice, the Website and/or the Service or any part of it or any of your passwords or accounts (or any part(s) thereof or related files and information) within any service, and may remove and discard any content or resources within any of the Services, for any reason, including, without limitation, for lack of use or if Teacher's Pet believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions.

 

Where there is a breach of these Terms and Conditions, the rights described in this paragraph are not Our only remedy and We may take any other action we reasonably deem appropriate in connection with such breach.

 

 

Copyright and Intellectual Property

 

 

All the content, apps, resources and the Websites themselves are protected by international copyright laws and intellectual property rights. The owner of these rights are Jason Loftus and Christina Loftus trading under the name of Teacher's Pet. All product and company names and logos contained within our Websites are the property of their respective owners.

 

Illustrations depicting characters or scenes from published books and stories are not endorsed in any way by the authors or publishers. The artwork within our resources is recreated using the original source as reference only. The resources are intended to be used to support the book/story and not to replace it. We encourage you to support both the authors and publishers by purchasing the books to use alongside our resources.

 

The use of any articles, information and resources available on the Websites are subject to copyright and are owned by Us. You must not reproduce, redistribute or directly share our resources, in full, in part or in an edited state for others in any form, this includes providing the downloaded files to others via any means or via distribution of printed resources. Instead we ask that you direct people to our website so that they may download the resources for themselves. Do not use our resources for commercial purposes or edit/amend/build upon the downloaded resource file in any way without prior consent. This includes using our resources as a template for your own creations whether intended for personal, public or commercial use.

 

You acknowledge that, by making use of our Websites, you are agreeing to comply with the above copyright terms and that any breach thereof is likely to result in legal proceedings being issued against you.

 

 

Shop Service

 

 

The Shop Service allows You to buy pre-made physical products of our own creation directly from the website and have them delivered to the address of your choosing. Unless otherwise chosen when checking out all goods are shipped using Royal Mail first class postage and will only be shipped to the UK mainland. We are happy to process international orders but these will incur additional postage costs depending on Your location.

 

When you order from the Shop Service this is deemed as an offer from you to us. We will only be deemed to have accepted this offer when the products have been prepared and sent to you. We therefore reserve the right to cancel an order for any reason and with a refund of the entire cost of the order.

 

We aim to ship all orders within 5 working days however in certain circumstances such as busy periods or when stock is low this can take up to 28 days. Please ensure you leave enough time between ordering and the time which you will require the products. Additional information regarding the current estimated time needed to fully and successfully process and ship orders can be found via the delivery information page located on the shop. This delivery information is offered as an estimate only.

 

Please ensure that the address registered on the Shop Service is correct as we cannot be held responsible if the address chosen is incorrect and the goods go missing.

 

We offer 'Recorded Delivery' options and we recommend that you choose this option when placing an order as it offers insurance should an order go missing. Teacher's Pet cannot be held responsible for orders that go missing in transit. We keep proof of postage for every order sent, this can be provided to you to aid a claim against Royal Mail should you need to contact them regarding a missing parcel.

 

Returns will only be accepted when orders are incorrect, of the wrong quantity or damaged. Returns for orders that are no longer wanted or are ordered in error will not be accepted. Returns must be requested within 5 working days of receiving the goods. Otherwise we shall have no liability to you for the order and no refund or exchange will be given. If however a legitimate problem with an order is reported within the timespan mentioned above we will give You the option to either make good any shortage or non-delivery or to replace any products that are damaged or defective pending a full return of the entire shipment of goods.

 

We will not be liable to You for any indirect or consequential loss, damage or expenses arising out of any problem You notify to Us and We shall have no liability to pay any money to You by way of compensation other than to refund to You the amount paid by You for the relevant order.

 

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase from our Websites. The importation or exportation of certain goods may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the products You purchase.

 

 

Payment

 

 

Payment via "PayPal", cash, all major Credit/Debit Cards, Bankers Draft, or BACS Transfer are all acceptable methods of payment. Our Terms are payment in full before any goods or services can be received.

 

All goods remain the property of the Company until paid for in full. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice/purchase/subscription via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

 

Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

 

 

Log Files

 


We use IP addresses to analyse trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

 

Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

 

 

Waiver

 

 

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
